An accomplished attorney with nearly 20 years of experience, Janine has litigated a wide range of civil cases, including due process/breach of contract disputes stemming from student or employment disciplinary proceedings, Title IX gender discrimination, Title VII employment discrimination, defamation, corporate disputes, professional malpractice, construction defect, Labor Law, Maritime/Admiralty and general negligence. She has extensive courtroom and mediation experience.

Janine started her career as an Assistant State Attorney in Miami Dade County, Florida, where she successfully prosecuted many felony and misdemeanor cases from inception through trial and post-trial appeals. For the past 15 years she worked at two prominent New York City firms and successfully represented corporations, building owners, general contractors, sporting facilities, insurance companies, hospitals, physicians and individuals in complex civil matters. A few examples of her accomplishments include dismissals for owners and general contractors accused of violating New York Labor Law sections 240(1), 241(6) and 200; favorable final determinations of several claims brought before the New York Division of Human Rights and New York City Commission on Human Rights for housing and employment discrimination; the successful prosecution of a defendant accused of attempted murder with the discharge of a firearm, resulting in a 25-year minimum mandatory sentence; and, a dismissal of a Complaint by motion in lieu of pleadings in a matter brought by a condominium board against a general contractor for allegations of construction defect.

Since joining Nesenoff & Miltenberg, LLP, Janine has expanded her practice of law to include the corporate disputes and the defense of college students and employees in disciplinary proceedings, ranging from general misconduct or sexual misconduct proceedings, COVID-19 violations, and cheating. She is also involved in all aspects of prosecuting civil lawsuits against colleges, universities and employers for violations of constitutional rights and contractual promises breached in connection with the mistreatment of accused students or employees, including conducting discovery, taking and defending depositions, drafting motions, participating in hearings and mediations, and preparing for trial.

In addition to practicing law, Janine served as an arbitrator for the New York City Civil Court, Bronx County, since 2010, where she was responsible for hearing cases and issuing decisions on a variety of small claims disputes.

Successfully defended students accused of sexual misconduct on and off-campus at Lafayette College and Cornell University, who were found not responsible after hearings and effectively defended decisions on appeal.

Negotiated a favorable informal resolution for a student accused of Title IX violations at Union College.

Reached a favorable settlement against a public institution after commencing an action for due process violations for erroneous findings of misconduct.

Attained a successful reduction of suspension for a student accused of sexual misconduct at Georgia Tech.

Successfully petitioned Widener University Delaware Law School for reinstatement of a student who was dismissed for poor scholarship.

Effectively opposed a motion for summary judgment in a negligence action against a supportive housing facility wherein our client was badly burned and suffered significant injuries.
